Salient Features of RTI act

  • All citizens possess the right to information.
  • Information can be obtained within 30 days from the date of request in a normal case. If information is a matter of life or liberty of a person, it can be obtained within 48 hours from time of request.
  • Every Public authority is under obligation to provide information on written request or request by electronic means. Certain information are prohibited, restrictions made for third party information
  • Appeal against the decision of the Central Information Commission or State Information commission can be made to an officer who is senior in rank.

Provisions under the RTI Act

Process of Filling an RTI application

  1. Information can be sought under Section 4/6
  2. Application filed under Section 6.
  3. Information has to be provided within 30 days
  4. Can seek information but not ask questions/opinions.
  5. If no information is provided, first appeal (under section 19) within the public authority (usually a senior officer) is made after 30 days.
  6. If you are still not satisfied. File a second appeal (under section 19) with information Commission within 90 days.
  7. If no reply is received, file a complaint (under section 18) directly with the information the information commissioner.
